A maximum of two cats are permitted per unit with Executive Board approval. Dogs are prohibited on property grounds. Unit owners must submit a written application to the Executive Board for authorization at least thirty (30) days prior to acquiring a pet or emotional support animal, or thirty (30) days before moving into any unit. This amendment is currently in effect and will be recorded with the Town of Lincoln following a final review by legal counsel.
There is a 70% minimum owner occupancy as a primary residence requirement. The Association is currently at 41% owner occupancy as a primary residence, and therefore, future Unit sales needs to be occupied by the owner(s) as a primary residence and not as a secondary residence.
Authorized Visitor Parking Hours: 7:00 AM to 3:00 PM
(Unrestricted visitor parking is available to all Units)
Restricted Visitor Parking Hours: 3:01 PM to 6:59 AM
(One visitor parking space allocated exclusively for two-bedroom Units)
In response to limited visitor parking serving 54 units, a community vote allocated one visitor parking space exclusively for two-bedroom Units during the restricted visitor parking hours on a first come first served basis. Additional street parking is available if needed.
In addition, occupying another Unit's assigned parking space or parking in areas not designated for resident parking are violations of the Association's governing documents
(Declaration, By-laws, Rules and Regulations) and is strictly prohibited.
Vehicles in violation of the parking regulations may be towed and any associated activities or expenses incurred will be the sole responsibility of the vehicle owner.
The operation and storage of outside cooking appliances such as BBQ grills, smokers, hibachis, and related components, including but not limited to propane tanks in the Units, common areas and limited common areas of the condominium, including but not limited to balconies and lawn areas are strictly prohibited.
For the safety and well-being of residents and guests, the maximum speed limit on the property grounds is 10 mph.
The Association has embraced the modern approach of electronic
communications to enhance efficiency and streamline interactions with members,
staying connected to keep the community engaged and informed.
Unit Owners shall carry insurance (e.g., in the form of a so-called HO-6 policy or equivalent coverage) for their own benefit and at their own cost and expense insuring their furniture, furnishings, carpeting and rugs and other personal property located within their respective Units or its appurtenances, and for such as is not covered by the Condominium master policies - particularly any deductible; provided that all such policies shall contain waivers of subrogation and further provided that the liability of the carriers issuing insurance obtained by the Executive Board shall not be affected or diminished by reason of any such additional insurance carried by any Unit Owner, or if so affected, it shall be deemed that the Unit Owners' insurance coverage has been assigned to the Association to the extent of such effect.
To the extent that there are insufficient insurance proceeds available, the Unit Owners and not the Condominium Association, Inc. shall bear the cost or expense of repair or replacement of damages to or within the Unit. Unit Owners shall in all events maintain liability insurance covering damage to the Property ni such reasonable amounts as the Executive Board may determine and, upon request, provide evidence thereof to the Executive Board. The maintenance by each Unit Owner of such insurance coverage is intended, in material part, for coverage of losses when loss payments under the Master Policy, after the deductible is accounted for, are insufficient to fully pay for repair or replacement resulting from damages to or within a Unit. The Executive Board, by Rule and Regulation, may set minimum standards as to the issuance of such policies, including, without limitation, as to the rating of the companies issuing such policies.
Upon the initial transfer of title from the Declarant to the Purchaser of each Unit, the Association shall collect from such Purchaser an amount equal to two (2) months estimated Common Expense Liability which amount shall be deposited into a segregated account for the uses and benefit of the Association (hereinafter the "Working Capital Fund)".
The purpose of this fund is to insure that the Association has sufficient cash available to meet unforeseen expenditures or to acquire additional equipment of services deemed necessary or desirable by the Executive Board. Amounts paid by Purchasers to the working Capital Fund are not to be considered as advance payments of the assessments. Said amounts are not refundable and are to be collected upon each subsequent transfer of a Unit.
In the discretion of the Executive Board, members of the Executive Board, including officers and non-officers of the Executive Board, may receive reasonable compensation for performing his or her duties as a member of the Executive Board, and said compensation shall be a line item on the budget of the Association.
The Association does not maintain a public office; therefore, in-person, phone, or video conference appointments must be arranged in advance, dependent on Executive Board availability.
